Snow Policy Enacted Due to Unprecedented Snowstorms in Philadelphia Area!

Two blizzards clobbered the Philadelphia region in the last week, resulting in historic annual snowfall totals in the city. Mayor Michael Nutter was prompted to declare a Snow Emergency for the City of Philadelphia on Saturday February 6th, Wednesday February 10th and again on Thursday February 11th. SPIN Staff responded to the emergency as they always have, by stepping up and getting the job done to assure all individuals were well supported throughout the record snowfall. It was a heroic effort and we greatly appreciate the work of all SPIN Staff and Managers throughout the weather emergency period. Clause 19.4 in our Collective Bargaining Agreement states: “In the event that the Mayor of Philadelphia declares a snow emergency, requiring that only essential personnel report to work, employees in the affected programs, (excluding residential employees), will not be expected to report to work and will be paid for that day at straight time exclusive of leave time. However, qualified employees in programs that are closed may be required to work if deemed necessary. All employees who are required to work (including residential employees) during the snow emergency will be compensated at one and one-half (1 ½) times their regular rate of pay for all hours worked. This section shall be limited to two snow days per contract year. Subsequent snow days will require the use of leave time by those employees who do not work. Article 12 will govern employees who do not work on subsequent snow days.” How This Affects Union Staff The snow event on Saturday, February 6th was the first of three “Snow Emergency” days declared by the Mayor. Union personnel required to work during the time period of 8am on Saturday 2/6 through 8am on Sunday 2/7 will be paid for all hours worked at a rate of one and one-half (1 ½) times their rate of pay as per the Union Contract, including any continuous “holdover” shifts after 8am on Sunday 2/7. The snow event on Wednesday, February 10th was the second of three “Snow Emergency” days declared by the Mayor. Union personnel that were required to work during the time period of 8am on Wednesday 2/10 through 8am on Thursday 2/11 will be paid for all hours worked at a rate of one and one-half (1 ½) times their rate of pay as per the Union Contract, including any continuous “holdover” shifts after 8am on Thursday 2/11. Non-essential staff who are assigned to work in the “affected programs” (Program closed) on 2/10, including but not limited to, Children’s Services, BEST Program, CIE, Health Services and Day Programs at NCC will be paid for that day at straight time exclusive of leave time. All staff who prescheduled leave time and/or called out during either “snow emergency” will have the appropriate number of hours deducted from their leave bank. Any union employee who was “redeployed” to residential services will be paid at one and one-half (1 ½) times their rate of pay. On 2/10, Union Staff who came to work who may not have been required and were released early will be paid for their whole shift at straight time with no use of leave time. The snow event on Thursday, February 11th was the third of three “Snow Emergency” days declared by the Mayor. As per the Union Contract, employees who are required to work on any snow emergency beyond the first two in any calendar year, (including residential employees) will be paid at their regular rate of pay. Employees in the “affected programs” will either use Leave Time or be redeployed to an open shift in another department. Employees who request Leave for the last work day prior to the President’s Day holiday on February 15th will not be required to provide a doctor’s note for that request.
